Parenting Matter Case Study: Preventing Unilateral Interstate Child Relocation
Case Overview
Court: Federal Circuit and Family Court of Australia, Melbourne Registry
Address: 305 William St, Melbourne VIC 3000
This case involved an urgent application filed on behalf of our client, the Father, in the Federal Circuit and Family Court of Australia. The primary objective was to restrain the Mother from relocating the child’s principal residence outside the State of Victoria.
Urgent Family Law Application & Interim Court Orders
An urgent application was submitted to the Court, leading to an immediate listing for an Interim Defended Hearing. The Father’s position was upheld, resulting in Orders that restrained the Mother by injunction from relocating the child’s principal place of residence outside Victoria. Additionally, Orders were made for the child to spend time with the Father.
Rebutting Family Violence & Substance Abuse Allegations
During the proceedings, the Mother alleged that the Father had committed family violence. The allegations were denied and there was no finding of fact regarding the family violence allegations.
The Mother also alleged that the Father used illicit substances. To address the substance use allegations, the Father undertook a hair follicle test, which produced negative results for illicit substances.
The Mother subpoenaed the testing facility to verify the identity of the individual tested. The photograph produced in response to the subpoena confirmed that the individual tested was indeed our client, thereby undermining the Mother’s claims.
The Mother also asserted that the Father used steroids but this allegation was refuted as the Father was participating in a supervised supplement program.
Final Orders & Increased Parenting Time Outcome
The matter was resolved favourably for the Father. Final Orders were made that swiftly increased the Father’s contact with the child, starting with immediate overnight contact and progressing to equal time with both parents by the following year. A final order was also made restraining the Mother by injunction from relocating the child’s principal residence outside the State of Victoria.
Key Takeaways & Family Court Success
The case concluded with a successful outcome for the Father, ensuring that the child’s relationship with his Father was maintained and protected, and the child’s residence remained within Victoria. The Father’s compliance with court procedures and the negative hair follicle test played crucial roles in securing this favourable outcome.
